Terms of Use
These Terms of Use govern your access to and use of The Casstle Co. platform, listings, and services.
The Casstle Co.
Operated by Per Square Feet Infraventures LLP
Effective Date: 9 October 2026
Last Updated: 28 October 2026
1. Introduction and Acceptance
These Terms of Use (“Terms”) govern your access to and use of https://www.thecasstle.co, including its pages, property listings, enquiry forms, content, digital features and related services (collectively, the “Platform”).
The Platform is operated by Per Square Feet Infraventures LLP (“the Company”), subject to confirmation of the exact registered legal name.
In these Terms, “the Company”, “we”, “us” and “our” refer to the above-mentioned legal entity.
By accessing, browsing or using the Platform, you agree to these Terms and the Company’s Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Platform.
2. Nature of the Platform
The Platform is intended to provide information about destination-led residential properties, second homes, holiday homes and related real-estate opportunities, and to enable users to submit enquiries regarding such opportunities.
Unless expressly stated otherwise in a separate written agreement, the Company does not itself own, develop, construct or sell the properties displayed on the Platform. Properties may be offered by independent developers, promoters, owners or other third parties (“Property Providers”).
Information about a property does not constitute a binding offer, allotment, reservation, promise of sale or guarantee that the property is available.
The actual nature of the Company’s activities, including any sales assistance, brokerage, referral, marketing or transaction-related services, shall be governed by the applicable agreements and law. Nothing in these Terms exempts the Company from any registration, disclosure or other legal obligation that may apply to its actual activities.
3. Eligibility and Permitted Use
You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform for property-related enquiries or transactions.
You agree to use the Platform only for lawful purposes and must not:
- Submit false, misleading, fraudulent or unauthorised information.
- Use the Platform to harass, threaten, defraud or mislead any person.
- Copy, scrape, extract, reproduce or commercially exploit Platform content, listings, databases or contact information without prior written permission, except as permitted by applicable law.
- Attempt to gain unauthorised access to the Platform, its systems, accounts or data.
- Upload malicious code, interfere with the Platform’s operation or circumvent reasonable security measures.
- Use automated tools to access the Platform in a manner that violates these Terms or applicable law.
- Misrepresent your identity, authority, affiliation or intention when contacting the Company or a Property Provider.
The Company may restrict or suspend access where reasonably necessary to protect the Platform, users, third parties or its legal interests, subject to applicable law.
4. Property Listings and Third-Party Information
Property listings and related information may be supplied by Property Providers or obtained from other sources believed to be relevant. Such information may include photographs, videos, plans, floor areas, prices, amenities, location details, specifications, approvals, construction status, possession timelines, availability and commercial terms.
Although the Company may take reasonable steps to maintain the quality of the information displayed, the Company does not warrant that every listing is accurate, complete, current, independently verified or free from error.
Information may change without notice. Images, renderings, sample layouts, furnishing representations and illustrative materials may not reflect the final delivered property. Prices may exclude taxes, registration charges, maintenance, furnishing, parking, statutory fees or other costs unless expressly stated.
Users must independently verify all material facts with the relevant Property Provider and appropriate authorities before making any financial commitment.
Nothing in this section excludes liability for fraud, wilful misconduct, misleading representations or other matters for which exclusion is prohibited by law.
5. Independent Property Providers
Property Providers are independent third parties unless a separate written agreement expressly establishes otherwise.
The Company does not automatically become the owner, seller, developer, construction manager, legal adviser, architect, lender, guarantor or representative of a Property Provider merely because its information appears on the Platform.
Unless expressly agreed in writing, the Company does not guarantee:
- The title, ownership, possession rights or encumbrance status of any property.
- The accuracy or completeness of project approvals, registrations, permits or disclosures.
- Construction quality, structural safety, project completion, possession dates or future development.
- The financial standing, conduct, solvency or performance of any Property Provider.
- The availability of a property, its future market value, rental yield, appreciation, resale potential or investment return.
- The performance or suitability of any third-party professional, contractor, consultant, lender or service provider.
These matters must be assessed through appropriate independent verification and, where necessary, professional advice.
6. No Investment, Legal or Financial Advice
Content on the Platform is provided for general informational purposes. It does not constitute personalised investment, financial, legal, tax, valuation or other professional advice.
Property purchases involve commercial, legal, market, liquidity and execution risks. Past performance, projected returns, indicative rental income or appreciation estimates do not guarantee future results.
You are responsible for evaluating the suitability of a property for your own purposes and obtaining independent advice before committing funds.
7. Enquiries, Introductions and Communications
Submitting an enquiry does not create an agency, brokerage, advisory, partnership, fiduciary or other professional relationship unless expressly established by a separate written agreement.
By submitting an enquiry and providing your contact details, you request that the Company contact you regarding your enquiry and, where relevant and consistent with the Privacy Policy and applicable law, share the necessary enquiry information with the relevant Property Provider or service partner so that your enquiry can be addressed.
You are responsible for ensuring that the information you submit is accurate and that you are authorised to provide it.
An enquiry does not guarantee a response, site visit, booking, reservation, allocation, discount or transaction. Any transaction remains subject to the relevant Property Provider’s terms, due diligence, availability, applicable law and executed agreements.
Where the Company provides a referral, marketing, sales-support or other service under a separate agreement, that agreement will govern the relevant commercial arrangement. Nothing in these Terms overrides mandatory legal obligations applicable to that service.
8. Pricing, Payments and Transactions
Unless expressly stated otherwise in a separate written agreement, the Company does not receive or hold property purchase consideration, booking amounts, deposits or other transaction funds on behalf of Property Providers or purchasers.
Users must verify the identity of the intended recipient and the purpose, refundability and contractual treatment of any payment before transferring money. Do not transfer funds to an individual or account merely because it is mentioned in a communication claiming to represent the Company.
Any booking, allotment, sale, purchase, cancellation, refund, possession or payment obligation is governed by the applicable agreement between the relevant parties and applicable law.
The Company’s fees, commissions, referral arrangements and other commercial entitlements, where applicable, are governed by separate written agreements and are not established by these Terms.
9. User Submissions and Communications
You retain ownership of content you lawfully submit to the Platform, subject to the rights of any third parties.
By submitting information, documents, photographs or other content, you grant the Company a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and use that content as reasonably necessary to operate the Platform, respond to your enquiry, provide the requested service and comply with legal obligations.
You represent that you have the necessary rights and permissions to submit such content and that doing so does not violate applicable law or another person’s rights.
You must not submit confidential information belonging to another person without proper authority, or transmit unlawful, defamatory, infringing or fraudulent material.
10. Intellectual Property
Unless otherwise indicated, the Platform’s design, branding, logos, text, graphics, editorial material, compilations, software and original content are owned by or licensed to the Company and are protected by applicable intellectual-property laws.
You may access and use the Platform for personal, lawful and non-commercial browsing and property research.
You must not, without prior written permission or a legal entitlement:
- Reproduce, republish, distribute or commercially exploit Platform content.
- Copy or systematically extract listings or databases.
- Remove proprietary notices or use the Company’s name, logo or branding in a manner that implies an unauthorised affiliation or endorsement.
- Create derivative products or competing databases using protected Platform material.
Third-party trademarks, photographs and listing materials remain subject to their respective owners’ rights.
11. Third-Party Websites and Services
The Platform may contain links, integrations or references to third-party websites, services or resources.
The Company does not control third-party websites and is not responsible for their content, availability, security, privacy practices or terms. Accessing them is at your own discretion and subject to their applicable terms.
The presence of a link or listing does not, by itself, constitute an endorsement or guarantee by the Company.
12. Availability and Changes to the Platform
The Company may modify, update, suspend or discontinue any part of the Platform, including features, listings or content, where reasonably necessary for operational, security, commercial or legal reasons.
The Company does not guarantee uninterrupted, error-free or continuously available access. The Platform may be affected by maintenance, network failures, third-party services or circumstances beyond the Company’s reasonable control.
The Company will not be liable for interruptions or changes to the extent liability may lawfully be excluded, subject to any mandatory rights and remedies available to users.
13. Disclaimers
To the maximum extent permitted by applicable law, the Platform and its general content are provided on an “as available” basis.
The Company disclaims implied warranties to the extent legally permissible, including implied warranties of suitability for a particular purpose, uninterrupted availability and accuracy of third-party information.
Nothing in these Terms excludes or restricts any warranty, representation, duty or liability that cannot lawfully be excluded or restricted, or any remedy that applicable law requires to remain available.
14. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, exemplary or consequential losses, loss of profits, loss of anticipated savings, loss of business opportunities, loss of data or reputational loss arising from or related to use of the Platform.
Subject to applicable law, the Company shall not be responsible for losses arising from:
- A Property Provider’s acts, omissions, representations, project performance or contractual breaches.
- A user’s reliance on unverified property information or failure to conduct due diligence.
- A third-party website, service, communication channel or technical system.
- Unauthorised access, technical disruption or events beyond the Company’s reasonable control.
- A user’s breach of these Terms or applicable law.
To the maximum extent legally permissible, the aggregate liability of the Company arising directly from use of the Platform shall not exceed the amount, if any, paid by the relevant user directly to the Company for the specific Platform service giving rise to the claim during the six months preceding the event giving rise to the claim.
This limitation does not apply to the extent prohibited by law, including where liability arises from fraud, wilful misconduct or other non-excludable obligations. It does not limit mandatory consumer rights or remedies.
15. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company, its partners, officers, employees and authorised representatives against third-party claims, losses, liabilities and reasonable legal expenses arising directly from:
- Your material breach of these Terms.
- Your unlawful use of the Platform or fraudulent conduct.
- Content you submit that infringes another person’s rights or violates applicable law.
- Your wilful misconduct or material misrepresentation.
This indemnity applies only to the extent the relevant claim or loss is attributable to your acts or omissions. It does not require you to indemnify the Company for the Company’s own fraud, wilful misconduct or liability that cannot lawfully be transferred.
16. Privacy and Personal Information
The Company’s collection, use, disclosure, storage and other processing of personal information are described in the Privacy Policy, which forms part of the overall terms governing your use of the Platform.
Please review the Privacy Policy before submitting personal information. Where consent or another lawful basis is required, the Company will handle the relevant processing in accordance with applicable law.
Privacy-related requests may be directed to the contact details set out below and in the Privacy Policy.
17. Suspension and Termination
The Company may restrict or terminate your access to the Platform where reasonably necessary because of a material breach of these Terms, suspected fraud, security risks, unlawful activity or a legal requirement.
Where appropriate and legally permissible, the Company may provide notice or an opportunity to address the relevant issue.
Termination does not extinguish rights, liabilities or obligations that accrued before termination. Provisions that by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability, indemnities and dispute provisions, will survive to the extent permitted by law.
18. Changes to These Terms
The Company may update these Terms from time to time to reflect changes in the Platform, its practices or applicable law.
The revised version will be posted on the Platform with an updated “Last Updated” date. Changes will take effect as permitted by applicable law. Where specific notice or consent is legally required, the Company will follow the applicable requirement.
Your continued use of the Platform after revised Terms become effective constitutes acceptance only to the extent recognised under applicable law. If you do not agree to a revision, you must discontinue use of the Platform.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to mandatory statutory jurisdiction, consumer-protection rights and the authority of any competent regulatory body or tribunal, courts having competent jurisdiction in Gurugram, Haryana, shall have jurisdiction over disputes arising from these Terms or use of the Platform.
Nothing in this clause prevents a consumer from approaching a forum or authority where applicable law grants that consumer the right to do so.
20. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, where legally permissible. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in effect.
A failure or delay by the Company in exercising a right does not constitute a waiver of that right. Any waiver must be interpreted in accordance with applicable law.
21. Entire Agreement and Order of Precedence
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, govern general use of the Platform.
A separately executed agreement may govern a specific transaction, referral, marketing engagement, sales mandate or other service. In the event of a conflict, the specific agreement will prevail for that subject matter to the extent stated in it and permitted by law.
Nothing in these Terms overrides mandatory statutory rights or obligations.
